WASHINGTON – Today, in a blatant assault upon civil liberties and the right to privacy, the Senate passed an unconstitutional domestic spying bill that violates the Fourth Amendment and eliminates any meaningful role for judicial oversight of government surveillance. The FISA Amendments Act of 2008 was approved by a vote of 69 to 28 and is expected to be signed into law by President Bush shortly. This bill essentially legalizes the president’s unlawful warrantless wiretapping program revealed in December 2005 by the New York Times.
‘Once again, Congress blinked and succumbed to the president’s fear-mongering. With today’s vote, the government has been given a green light to expand its power to spy on Americans and run roughshod over the Constitution,’ said Anthony D. Romero, Executive Director of the American Civil Liberties Union. ‘This legislation will give the government unfettered and unchecked access to innocent Americans’ international communications without a warrant. This is not only unconstitutional, but absolutely un-American.’
The FISA Amendments Act nearly eviscerates oversight of government surveillance by allowing the Foreign Intelligence Surveillance Court (FISC) to review only general procedures for spying rather than individual warrants. The FISC will not be told any specifics about who will actually be wiretapped, thereby undercutting any meaningful role for the court and violating the Fourth Amendment’s protection against unreasonable search and seizure.

Ever since the President’s illegal warrantless eavesdropping program was revealed by the New York Times’ Jim Risen and Eric Lichtblau back in December, 2005, there has been a faction of neoconservatives and other extremists on the Right calling for the NYT reporters and editors to be criminally prosecuted — led by the likes of Bill Kristol (now of the NYT), Bill Bennett (of CNN), Commentary Magazine and many others. In May, 2006, Alberto Gonzales went on ABC News and revealed that the DOJ had commenced a criminal investigation into the leak, and then “raised the possibility  that New York Times journalists could be prosecuted for publishing classified information.”
That was one of the more revealing steps ever taken by Bush’s DOJ under Gonzales: the administration violated multiple federal laws for years in spying on Americans, blocked all efforts to investigate what they did or subject it to the rule of law, but then decided that the only real criminals were those who alerted the nation to their lawbreaking — whistleblowers and journalists alike. Even Gonzales’ public musing about criminal prosecutions could have had a devastating effect — if you’re a whistleblower or journalist who uncovers secret government lawbreaking, you’re obviously going to think twice (at least) before bringing it to light, given the public threats by the Attorney General to criminally prosecute those who do.

In 1858, Oliver Wendell Holmes coined the phrase, “The Hub of the Solar
System,” when referring to the Massachusetts State House in an Atlantic
Monthly article, “The Autocrat of the Breakfast Table,” in which he
boastfully implied that Boston at that time was the center of everything intellectual.
One hundred and forty nine years after Holmes penned the affectionate metaphor
and two hundred and thirty four years after the infamous Boston Tea Party, Bostonians
are again attempting to appeal to the “Hub’s” intellectual prowess,
this time with regard to the academic and scientific challenges taking place
around the world concerning the government’s official explanations of the September
11, 2001 attacks.

According to Jessica Lee of Indypendent and Kamau Karl Franklin of the Center for Constitutional Rights, the Homegrown Terrorism Prevention Act was penned with plenty of help from the RAND Corporation.
“Rep. Jane Harman, Democrat from California, has had a lengthy relationship with the Rand Corporation,” Lee tells Democracy Now, although she was unable to determine if RAND wrote the bill. On the 12th anniversary of the OKC bombing, Rep. Harman, as chair of the Homeland Security Subcommittee on Intelligence, Information Sharing and Terrorism Risk Assessment, introduced the bill in the House of Representatives.
“The ‘Homegrown Terrorism Prevention Act of 2007′ seeks to address the roots causes of radicalization, and would establish a grant program to provide funds to States to foster badly needed vertical information sharing from the Intelligence Community to the local level and from local sources to state and federal agencies,” explains Harman’s website. “It also creates a Center of Excellence for the Prevention of Radicalization and Home Grown Terrorism to examine the social, criminal, political, psychological and economic roots of domestic terrorism and to propose solutions, and promotes international collaboration on strategies to combat radicalization.”
Franklin mentions Brian Michael Jenkins, an “expert” on “terrorism, counterinsurgency, and homeland security,” according to RAND. In the six years since the tragic events of September 11th, 2001, the mainstream media in America has largely been a mouthpiece of the Bush administration. A few days ago, a group of lawyers from western Massachusetts met with the local congressman, Democrat John Olver. Their request was that Olver take part in the urgent effort to impeach Bush and Cheney. Olver responded by saying that he had no intention of doing anything to support impeachment. He went further, offering the information that the United States would soon attack Iran, and that these hostilities would be followed by the imposition of a martial law regime here.
According to reports in the British press, the Cheney war party has gained the upper hand in the secret councils of the Bush White House, pushing aside the purported hesitations of Miss Rice, Secretary Gates, and the NATO allies to chart a direct course towards war with Iran:

Dennis Kucinich: First of all, you have to understand that all over the country people are concerned about whether or not they’ve been told the truth about 9/11 and the way that the administration handled 9/11, taking us into a war against Iraq that had nothing to do with 9/11. It deepened people’s suspicions about the possibility there may have been a cover-up. Because, why would the government lie about a cause for war? And so, what I’m saying is that I respect the concerns people have about whether they’ve been told the truth or not.

Last week’s announcement that the terrorist threat warning level has been raised in parts of New York, New Jersey, and Washington, D.C. has led to dramatic and unprecedented restrictions on the movements of citizens. Americans wishing to visit the U.S. Capitol must, for example, pass through several checkpoints and submit to police inspection of their cars and persons.
Many Americans support the new security measures because they claim to feel safer when the government issues terror alerts and fills the streets with militarized police forces. As one tourist interviewed this week said, “It makes me feel comfortable to know that everything is being checked.” It is ironic that tourists coming to Washington to celebrate the freedoms embodied in the Declaration of Independence are so eager to give up those freedoms with no questions asked.
Freedom is not defined by safety. Freedom is defined by the ability of citizens to live without government interference. Government cannot create a world without risks, nor would we really wish to live in such a fictional place. Only a totalitarian society would even claim absolute safety as a worthy ideal, because it would require total state control over its citizens’ lives. This doesn’t stop governments, including our own, from seeking more control over and intrusion into our lives. As one Member of Congress stated to the press last week, “people who don’t want to be searched don’t need to come on Capitol grounds.” What an insult! The Capitol belongs… Continue reading
