Judge dismisses scores of Guantánamo habeas cases

WASHINGTON — A federal judge has dismissed more than 100 habeas corpus
lawsuits filed by former Guantánamo captives, ruling that because the Bush and
Obama administrations had transferred them elsewhere, the courts need not decide
whether the Pentagon imprisoned them illegally.

The ruling dismayed attorneys for some of the detainees who’d hoped any favorable
U.S. court findings would help clear their clients of the stigma, travel restrictions
and, in some instances, perhaps more jail time that resulted from their stay
at Guantánamo.

U.S. District Judge Thomas F. Hogan wrote that he was "not unsympathetic"
to the former detainees’ plight. "Detention for any length of time can
be injurious. And certainly associations with Guantánamo tend to be negative,"
he wrote.

But the detainees’ transfer from Guantánamo made their cases moot. "The
court finds that petitioners no longer present a live case or controversy since
a federal court cannot remedy the alleged collateral consequences of their prior
detention at Guantánamo," he wrote.

Hogan’s ruling, issued last Thursday, but not widely publicized, closed the
files on 105 habeas corpus petitions, many of which had been pending for years
as the Bush administration resisted the right of civilian judges to intervene
in military detentions. The U.S. Supreme Court resolved that issue in 2008,
ruling in Boumediene v. Bush that the detainees could challenge their captivity
in civilian court. Since then, judges have ordered the release of 34 detainees
while upholding the detention of 12.

9/11 Mother Demands Obama Try Terrorist Plotters In Civilian Court

In anticipation of a final announcement as to the trial venue for the 9/11 plotters, September 11th Families for Peaceful Tomorrows is warning the president against “buckling to political pressure,” calling the use of military tribunals the “wrong thing to do.”

In a nearly four-minute long video, Donna Marsh O’Connor — a Peaceful Tomorrows member who lost her pregnant daughter when the Twin Towers collapsed — speaks both to the broad notion that America has a “historic commitment to justice” and, more narrowly, to the horse-trading politics that now surround terrorist trials. Reflecting disappointment with recent signals from the White House, O’Connor calls specifically for the president to reject a reported compromise proposal with Sen. Lindsey Graham (R-S.C.) in which the administration would drop plans for civilian trials in exchange for Republican support for the closure of Gitmo.

“As 9/11 families, we have suffered greatly and waited almost nine years to see justice done with our own eyes,” O’Connor says. “We understand that you face political pressure to back down. We ask that you do not allow fear and prejudice to govern your decision as we are not afraid. We know our country is strong enough to hold on to our values in the face of terrorism.”

The video follows other efforts from Peaceful Tomorrows to advocate for civilian trials for the 9/11 suspects.

Colleen Rowley: Minders Ensured She Didn’t Say Anything About 9/11 the FBI Didn’t WANT Told, Even to Government Officials With Top Security Clearance

FBI whistleblower Coleen Rowley was interviewed by Scott Horton, professor at Columbia Law School and Contributing Editor of Harper’s Magazine.

Rowley said that in her testimony to the Joint Intelligence Committee regarding 9/11, she was “minded”. Specifically, she said that “FBI minders” listened to her every word, to trail her and make sure that she didn’t tell government personnel with top secret clearance even higher than her own anything which the FBI did not want to be told.

While this might sound fantastic, it is nothing new.

As I wrote a year ago:

9/11 Commission chair Thomas Kean points out that if “minders” had been present during the Commission’s investigation, that would have been intimidation, which would have stemmed the flow of testimony from the witnesses:
I think the commission feels unanimously that it’s some intimidation to have somebody sitting behind you all the time who you either work for or works for your agency. You might get less testimony than you would.

However, that’s exactly what happened to Kean’s own 9/11 Commission.

Did the CIA test LSD in the New York City subway system?

On Nov. 28, 1953, Frank Olson, a bland, seemingly innocuous 42-year-old government scientist, plunged to his death from room 1018A in New York’s Statler Hotel, landing on a Seventh Avenue sidewalk just opposite Penn Station.

Olson’s ignominious end was written off as an unremarkable suicide of a depressed government bureaucrat who came to New York City seeking psychiatric treatment, so it attracted scant attention at the time.

But 22 years later, the Rockefeller Commission report was released, detailing a litany of domestic abuses committed by the CIA. The ugly truth emerged: Olson’s death was the result of his having been surreptitiously dosed with LSD days earlier by his colleagues.

The shocking disclosure led to President Gerald Ford’s apology to Olson’s widow and his three children, who accepted a $750,000 civil payment for his wrongful death.

But the belated 1975 mea culpa failed to close a tawdry chapter of our nation’s past. Instead it generated more interest into a series of wildly implausible “mind control” experiments on an unsuspecting populace over three decades.

Much of this plot unfolded here, in New York, according to H.P. Albarelli Jr., author of “A Terrible Mistake: The Murder of Frank Olson and the CIA’s Secret Cold War Experiments.”

In a sad commentary on the currently disintegrating state of “main stream media”, I found myself ambushed on Saturday, March 6th, just ten minutes after I arrived at a conference outside Philadelphia on “9-11, the Wars and Our Broken Constitution”.

So although I was a little surprised that the Nightline TV crew was there, I immediately consented to an interview before anyone had a chance to warn me that the TV show was trying to concoct a connection between the conference and the mentally ill young man who had been killed a few days before while shooting at Pentagon guards.

From the very first question Mr. Bury launched, it was clear, however, that he was not interested in the truth, and that I would not fare any better than someone who consents to go on Bill O’Reilly’s or Glenn Beck’s show.

The Washington Times is a newspaper that looks with favor upon the Bush/Cheney/Obama/neocon wars of aggression in the Middle East and favors making terrorists pay for 9/11. Therefore, I was surprised to learn on February 24 that the most popular story on the paper’s website for the past three days was the “Inside the Beltway” report, “Explosive News,” about the 31 press conferences in cities in the US and abroad on February 19 held by Architects and Engineers for 9/11 Truth, an organization of professionals which now has 1,000 members.

I was even more surprised that the news report treated the press conference seriously. How did three World Trade Center skyscrapers suddenly disintegrate into fine dust? How did massive steel beams in three skyscrapers suddenly fail as a result of short-lived, isolated, and low temperature fires? “A thousand architects and engineers want to know, and are calling on Congress to order a new investigation into the destruction of the Twin Towers and Building 7,” reports the Washington Times.

The paper reports that the architects and engineers have concluded that the Federal Emergency Management Agency and the National Institute of Standards and Technology provided “insufficient, contradictory and fraudulent accounts of the circumstances of the towers’ destruction” and are “calling for a grand jury investigation of NIST officials.”

The Media Response to the Growing Influence of the 9/11 Truth Movement – Part II: A Survey of Attitude Change in 2009-2010

Abstract

In the past year, in response to emerging independent science on the 9/11 attacks, nine corporate, seven public, and two independent media outlets aired analytic programs investigating the official account.

Increasingly, the issue is treated as a scientific controversy worthy of debate, rather than as a “conspiracy theory” ignoring science and common sense.

This essay presents these media analyses in the form of 18 case studies.

Eight countries — Britain, Canada, Denmark, France, the Netherlands, New Zealand, Norway and Russia — have allowed their publicly-owned broadcasting stations to air the full spectrum of evidence challenging the truth of the official account of 9/11.

This more open approach taken in the international media — I could also have included the Japanese media — might be a sign that worldwide public and corporate media organizations are positioning themselves, and preparing their audiences, for a possible revelation of the truth of the claim that forces within the US government were complicit in the attacks — a revelation that would call into question the publicly given rationale for the military operations in Iraq, Afghanistan, and Pakistan.

The evidence now being explored in the international media may pave the way for the US media to take an in-depth look at the implications of what is now known about 9/11, and to re-examine the country’s foreign and domestic policies in the light of this knowledge.

Yes, America is Still in an Official State of Emergency

A reader asked whether the U.S. is still in an official state of emergency, and if so, what that means.

The answer is yes, we are still in a state of emergency.

Specifically:

On September 11, 2001, the government declared a state of emergency. That declared state of emergency was formally put in writing on 9/14/2001:

“A national emergency exists by reason of the terrorist attacks at the World Trade Center, New York, New York, and the Pentagon, and the continuing and immediate threat of further attacks on the United States.

NOW, THEREFORE, I, GEORGE W. BUSH, President of the United States of America,
by virtue of the authority vested in me as President by the Constitution and the laws of the United States, I hereby declare that the national emergency has existed since  September 11, 2001 . . . .”

That declared state of emergency has continued in full force and effect from 9/11 [throughout the Bush administration] to the present.

On September 10 2009, President Obama continued the state of emergency:

The terrorist threat that led to the declaration on September 14, 2001, of a national emergency continues. For this reason, I have determined that it is necessary to continue in effect after September 14, 2009, the national emergency with respect to the terrorist threat.

What I call the Weird Factor, for lack of a better name, seems to have become a permanent feature of our post-9/11 world, a dark and sinister leitmotif that plays in the background. On 9/11, of course, the Factor was on full display as a whole string of unusual events and unexplained phenomena were visited on us. The 9/11 Commission did little to clear these matters up, for the most part because they didn’t address them. Just a few for the record: Bush reading My Pet Goat to schoolchildren after being told of the attacks, the sudden appearance of the “Israeli art students” — and their buddies, the “laughing Israelis” — in the months and weeks leading up to the attacks, and the apparent passivity of US air defenses on that fateful day.

I mean, how is it possible that the terrorists actually hit the Pentagon, the symbolic fortress of America’s alleged military supremacy? After spending untold trillions on “defense” over the years, a sum that never declines in real terms, and driving ourselves into near-bankruptcy on account of it, how in the name of all that’s holy did nineteen men armed with box-cutters manage to drive Don Rumsfeld stumbling into the street, literally running for his life?

Cass Sunstein has long been one of Barack Obama’s closest confidants. Often mentioned as a likely Obama nominee to the Supreme Court, Sunstein is currently Obama’s head of the Office of Information and Regulatory Affairs where, among other things, he is responsible for “overseeing policies relating to privacy, information quality, and statistical programs.” In 2008, while at Harvard Law School, Sunstein co-wrote a truly pernicious paper proposing that the U.S. Government employ teams of covert agents and pseudo-”independent” advocates to “cognitively infiltrate” online groups and websites — as well as other activist groups — which advocate views that Sunstein deems “false conspiracy theories” about the Government. This would be designed to increase citizens’ faith in government officials and undermine the credibility of conspiracists. The paper’s abstract can be read, and the full paper downloaded, here.

Sunstein advocates that the Government’s stealth infiltration should be accomplished by sending covert agents into “chat rooms, online social networks, or even real-space groups.” He also proposes that the Government make secret payments to so-called “independent” credible voices to bolster the Government’s messaging (on the ground that those who don’t believe government sources will be more inclined to listen to those who appear independent while secretly acting on behalf of the Government). New revelations about the failed Christmas Day attack on Northwest Airlines Flight 253 continue to emerge as does evidence of a systematic cover-up.

With the White House in crisis mode since the attempted bombing, President Obama met for two hours January 5 with top security and intelligence officials. Obama said that secret state agencies “had sufficient information to uncover the terror plot … but that intelligence officials had ‘failed to connect those dots’,” The New York Times reports.

The latest iteration of the “dot theory” floated by the President, aided and abetted by a compliant media, claims “this was not a failure to collect intelligence” but rather, “a failure to integrate and understand the intelligence that we already had.”

“Mr. Obama’s stark assessment that the government failed to properly analyze and integrate intelligence served as a sharp rebuke of the country’s intelligence agencies,” declared the Times uncritically.

While the President’s remarks may have offered a “sharp [rhetorical] rebuke,” Obama’s statement suggests that no one will be held accountable. Indeed, the President “was standing by his top national security advisers, including those whose agencies failed to communicate with one another.”

While the President may be “standing by” his national security advisers, the question is, are the denizens of America’s secret state standing by him? One well-connected Washington insider, MSNBC pundit Richard Wolffe, isn’t so sure.

Obama’s lies over the Afghanistan war remind us of the lessons of Nineteen Eighty-Four

In Nineteen Eighty-Four, George Orwell described a superstate, Oceania, whose language of war inverted lies that “passed into history and became truth. ‘Who controls the past,’ ran the Party slogan, ‘controls the future: who controls the present controls the past’.”

Barack Obama is the leader of a contemporary Oceania. In two speeches at the close of the decade, the Nobel Peace Prize-winner affirmed that peace was no longer peace, but rather a permanent war that “extends well beyond Afghanistan and Pakistan” to “disorderly regions, failed states, diffuse enemies”. He called this “global security” and invited our gratitude. To the people of Afghanistan, which the US has invaded and occupied, he said wittily: “We have no interest in occupying your country.”

In Oceania, truth and lies are indivisible. According to Obama, the American attack on Afghanistan in 2001 was authorised by the United Nations Security Council. There was no UN authority. He said that “the world” supported the invasion in the wake of the 11 September 2001 attacks. In truth, all but three of 37 countries surveyed by Gallup expressed overwhelming opposition. He said that America invaded Afghanistan “only after the Taliban refused to turn over Osama Bin Laden”. In 2001, the Taliban tried three times to hand over Bin Laden for trial, Pakistan’s military regime reported, and they were ignored.

Is Anyone Telling Us the Truth?

Photo of Paul Craig RobertsWhat are we to make of the failed Underwear Bomber plot, the Toothpaste, Shampoo, and Bottled Water Bomber plot, and the Shoe Bomber plot? These blundering and implausible plots to bring down an airliner seem far removed from al-Qaida’s expertise in pulling off 9/11.

If we are to believe the U.S. government, Khalid Sheikh Mohammed, the alleged al-Qaida “mastermind” behind 9/11, outwitted the CIA, the NSA, indeed all 16 U.S. intelligence agencies as well as those of all U.S. allies including Mossad, the National Security Council, NORAD, Air Traffic Control, Airport Security four times on one morning, and Dick Cheney, and with untrained and inexperienced pilots pulled off skilled piloting feats of crashing hijacked airliners into the World Trade Center towers, and the Pentagon, where a battery of state of the art air defenses somehow failed to function.

After such amazing success, al-Qaida would have attracted the best minds in the business, but, instead, it has been reduced to amateur stunts.

The Underwear Bomb plot is being played to the hilt on the TV media and especially on Fox “news.” After reading recently that The Washington Post allowed a lobbyist to write a news story that preached the lobbyist’s interest, I wondered if the manufacturers of full body scanners were behind the heavy coverage of the Underwear Bomber, if not behind the plot itself. In America, everything is for sale. Integrity is gone with the wind.

Recently I read a column by an author who has a “convenience theory” about the Underwear Bomber being a Nigerian allegedly trained by al-Qaida in Yemen.…

Counterterrorism in Shambles; Why?

Yesterday, a blogger with the PBS’ NewsHour asked former CIA analyst Ray McGovern to respond to three questions regarding recent events involving the CIA, FBI, and the intelligence community in general.

Two other old intelligence hands were asked the identical questions, queries that are typical of what radio/TV and blogger interviewers usually think to be the right ones. So there is merit in trying to answer them directly, such as they are, and then broadening the response to address some of the core problems confronting U.S. counter-terror strategies.

After drafting his answers, McGovern asked former FBI attorney/special agent Coleen Rowley, a colleague in Veteran Intelligence Professionals for Sanity (VIPS) to review his responses and add her own comments at the end. The Q & A is below:

Question #1 – What lapses in the American counter terrorism apparatus made the Christmas Day bombing plot possible? Is it inevitable that certain plots will succeed?

The short answer to the second sentence is: Yes, it is inevitable that “certain plots will succeed.” A more helpful answer would address the question as to how we might best minimize their prospects for success. And to do this, sorry to say, there is no getting around the necessity to address the root causes of terrorism or, in the vernacular, “why they hate us.”

Suicide claims more US military lives than Afghan war

American military personnel are continuing to take their own lives in unprecedented
numbers, as the wars in Afghanistan and Iraq wars drag on. By late November,
at least 334 members of the armed forces had committed suicide in 2009, more
than the 319 who were killed in Afghanistan or the 150 who died in Iraq. While
a final figure is not available, the toll of military suicides last year was
the worst since records began to be kept in 1980.

The Army, National Guard and Army Reserve lost at least 211 personnel to suicide.
More than half of those who took their lives had served in either Iraq or Afghanistan.
The Army suicide rate of 20.2 per 100,000 personnel is higher than that registered
among males aged 19 to 29, the gender age bracket with the highest rate among
the general population. Before 2001, the Army rarely suffered 10 suicides per
100,000 soldiers.

The Navy lost at least 47 active duty personnel in 2009, the Air Force 34 and
the Marine Corp, which has been flung into some of the bloodiest fighting in
Iraq and Afghanistan, 42. The Marine suicide rate has soared since 2001 from
12 to at least 19.5 per 100,000.

For every death, at least five members of the armed forces were hospitalised

Careful investigation leads one to notice that a number of intriguing groups of people and organizations converged on the events of September 11th, 2001. An example is the group of men who were members of Cornell University’s Quill & Dagger society. This included Paul Wolfowitz, National Security Advisors Sandy Berger and Stephen Hadley, Marsh & McLennan executive Stephen Friedman, and the founder of Kroll Associates, Jules Kroll. Another interconnected group of organizations is linked to these Cornell comrades, and is even more interesting in terms of its members being integral to the events of 9/11, and having benefited from those events.

After the 1993 bombing of the World Trade Center (WTC), a company called Stratesec (or Securacom) was responsible for the overall integration of the new security system designed by Kroll Associates. Stratesec had a small board of directors that included retired Air Force General James Abrahamson, Marvin Bush (the brother of George W. Bush) and Wirt Walker III, a cousin of the Bush brothers. Other directors included Charles Archer, former Assistant Director in charge of the FBI’s Criminal Justice Information Services Division, and Yousef Saud Al Sabah, a member of the Kuwaiti royal family.[1]

Yousef Saud Al Sabah was also chairman of the Kuwait-American Corporation (KuwAm), which between 1993 and 1999 held a controlling share of Stratesec.
