NEW YORK — The American Civil Liberties Union today released a statement from 31 9/11 victims’ family members challenging the legitimacy of the Guantánamo military commissions and their ability to achieve justice.

9/11 FAMILY MEMBERS CHALLENGE LEGITIMACY OF GUANTÁNAMO MILITARY COMMISSIONS
As family members who lost loved ones on 9/11, we feel compelled to speak out about this week’s proceedings at Guantánamo. Recently, the Guantánamo military commissions office announced that victims’ family members would be permitted, on a lottery basis, to attend the Guantánamo legal hearings of those accused of planning the 9/11 attacks. The lottery system inherently results in the granting of media attention to the select few who are chosen, and whose views are not necessarily representative of all victims’ families. The media coverage of Monday’s commission hearings included statements attributed to attending family members that the tribunals provided a fair hearing for these prosecutions and that family members “were struck by the extensive rights accorded the accused men.”
While we support everyone’s right to their individual opinions about these proceedings, including, of course, other family members who have suffered the devastation we have, we also feel obliged to make clear that many of us do not believe these military commissions to be fair, in accordance with American values, or capable of achieving the justice that 9/11 family members and all Americans deserve.

On October 27, 2008, WeAreChangeLA’s Jeremy Rothe-Kushel was on hand to cover an event with William Bratton, the Chief of the LAPD. Bratton was at a Townhall LA event at the Omni Hotel in Downtown LA to give a talk entitled “Crime and Your Bottom Line.” Although Bratton was there to focus on the future of the LAPD in relationship to development and crime-prevention, there was still a media buzz humming about an article Bratton had penned a week earlier with ‘terrorism expert’ R.P. The article, entitled “Osama Bin Laden wants a vote, so beware a late October surprise,” warned that if “Bin Laden wants to engineer a late-October surprise in 2008, an attack on a significant American economic target may be one of the most tempting opportunities he has had in recent years.” In addition to asserting that “U.S. intelligence is worried” because a “2007 National Intelligence Estimate said that Al Qaeda has reconstituted and may again be capable of hitting the U.S. mainland,” the article also claimed that “Bin Laden may have already begun to weigh in on our coming elections,” because in September, “Al Qaeda launched an assault against the American Embassy in Yemen.”
Bratton, who had worked under Rudolph Giuliani at the helm of NYPD in the 90’s pursuing the “broken windows” policy, became LAPD Police Chief in 2002. Damn you, Osama bin Laden! Here’s another rotten thing you’ve done to us: After 9/11, untold thousands of New Yorkers bought machines that detect traces of biological, chemical, and radiological weapons. But a lot of these machines didn’t work right, and when they registered false alarms, the police had to spend millions of dollars chasing bad leads and throwing the public into a state of raw panic.
OK, none of that has actually happened. But Richard Falkenrath, the NYPD’s deputy commissioner for counterterrorism, knows that it’s just a matter of time. That’s why he and Mayor Michael Bloomberg have asked the City Council to pass a law requiring anyone who wants to own such detectors to get a permit from the police first. And it’s not just devices to detect weaponized anthrax that they want the power to control, but those that detect everything from industrial pollutants to asbestos in shoddy apartments. Want to test for pollution in low-income neighborhoods with high rates of childhood asthma? Gotta ask the cops for permission. Why? So you “will not lead to excessive false alarms and unwarranted anxiety,” the first draft of the law states.

From 9/24 to 10/1/07 I traveled throughout Louisiana and Texas, with reporter Jordan Green, investigating the death of 9/11 researcher Dr. David Graham.
Our suspicions were validated: there’s a huge story here. It’s almost overwhelming. The best way to summarize is to publish my complaint filed last week with the Department of Justice’s Office of the Inspector General.

September 6, 2007 — Two more cops have died of 9/11-related lung cancer, according to their families.
Officer Frank Macari, 51, died on Monday, after a five-year battle with the disease.
Macari, a 13-year veteran of the force assigned to Brooklyn, developed a tumor on his leg in December 2001, after working at Ground Zero. He leaves a wife and stepdaughter.
Officer Madeline Caro, 41, a 16-year veteran, succumbed to lung cancer in July. Carlo, assigned to the South Bronx, also spent days at the World Trade Center site. She leaves a son and daughter.
Macari’s family will file papers, as Carlo’s family has done, to obtain line-of-duty benefits from the NYPD.
Meanwhile, the sixth annual NYPD 9/11 Memorial Weekend begins tomorrow with a 1 p.m. parade in lower Manhattan, ending at the police memorial wall at Liberty Street and South End Avenue. The weekend includes a Saturday-night concert at Town Hall in honor of the NYPD’s 9/11 victims. It stars tenor Ronan Tynan.

April 22, 2007 — Twenty-six firefighters who toiled at Ground Zero came down with sarcoidosis, an inflammatory illness that often attacks the lungs, in the five years after 9/11 – a significant increase, a new study has found.
The study has angered the Patrolmen’s Benevolent Association, which complains that the NYPD has refused to acknowledge that 9/11 caused sarcoidosis in cops.
Half the firefighter cases were diagnosed in the first year after 9/11 – a rate six times higher than the average for the Bravest in the 15 years before 9/11, according to a paper to be published in CHEST, a medical journal.
The results “strongly argue for improved respiratory protection” at future fires, disasters and toxic sites, says the report, whose authors include FDNY top doctors David Prezant and Kerry Kelly.
The PBA, which has its own registry of ailing WTC responders, counts 19 cops with sarcoidosis.
Unlike the FDNY, the NYPD has been reluctant to link the disease to 9/11.
The NYPD has also rejected some cops’ medical bills for sarcoidosis.
“First they denied any connection between the WTC and sarcoidosis. Now that there’s scientific evidence, they refuse to accept it,” PBA president Patrick Lynch told The Post.
NYPD spokesman Paul Browne said Commissioner Ray Kelly welcomed line-of-duty death benefits recently given the daughter of detective James Zadroga, 34, a 9/11 responder who died of respiratory illness.
“The department hasn’t refused to acknowledge a link. The medical division is reviewing the cases,” Browne said.

It was October 6, 2004, three years after Ernie Vallebuona’s three-month stint as a rescue and recovery worker at ground zero in the wake of the 9-11 terrorist attacks, and he was hunched over and trembling, racked by a pain like nothing he had experienced in his 40 years of sound health. He had just returned to his Rockland County home after finishing the midnight-to-8 a.m. shift in the NYPD vice unit, where he’d reported to work for the last six years. Vallebuona had bought some fish from a street vendor near his office, on the Lower East Side. And as he drove the 35 miles from Manhattan to New City, he chalked up a searing stomachache to food poisoning. Maybe the vendor had filleted that fish with a dirty machete?

Homeland Security, the “Keystone Stasi,” Now Tracks and Enforces Local Police Warrants
June 20, 2006: For many years, those working to create a total surveillance state have employed the “salami tactic” of taking away our freedoms one slice at a time. Laws that directly challenge constitutional rights, like the USA PATRIOT Act, are the spectacular exception. Agencies like FEMA quietly prepare plans for martial law, and have built a “Shadow Government” for military rule without need of a written order. The Bush administration for its part has constantly tested the waters, establishing new realities by fiat (as in its creation of the “enemy combatant” category to justify unlimited detention without charges), or floating test balloons like the “Total Information Awareness” program (which was withdrawn officially, even as the NSA’s telephone surveillance proceeded to implement its spirit behind the scenes).
Now we must all realize that at some point, the salami runs out. It no longer makes sense to say that our government is creating a police state. The fact is, that state has arrived, complete with One Big Database and the establishment of universal jurisdictions. In February 2005 , “Speakers at the national meeting of the American Association for Advancement of Science expressed concern Sunday that some scientists in key federal agencies are being ignored or even pressured to change study conclusions that don’t support policy positions.” Their concerns are well-founded. In June 2005, The New York Times reported that Philip A. Cooney, “removed or adjusted descriptions of climate research that government scientists and their supervisors, including some senior Bush administration officials, had already approved” so as to play down emissions’ links to Global Warming. Mr. Cooney served as chief of staff for the White House Council on Environmental Quality. Now, however, he serves Exxon . In July 2005, the EPA purposefully held back incriminating reports about our fuel economy so an Energy Bill that served not the people, but the corporations, would pass. As quoted by CBS News , the energy bill “sends billions of dollars in tax breaks and subsidies to energy companies, but is expected to do little to reduce U.S. oil consumption or dampen high energy prices.” The EPA’s report stated, “loopholes in American fuel economy regulations have allowed automakers to produce cars and trucks that are significantly less fuel-efficient, on average than they were in the late 1980’s.” No wonder they didn’t want it to be known. We’ve done nothing to become more fuel-efficient, and in fact, have gone backwards. Now, as a result, we’ve passed an energy bill that helps us not at all.
