We urge Attorney General Eric Holder to appoint a non-partisan independent Special Counsel to immediately commence a prosecutorial investigation into the most serious alleged crimes of former President George W. Bush, former Vice President Richard B. Cheney, the attorneys formerly employed by the Department of Justice whose memos sought to justify torture, and other former top officials of the Bush Administration.

A very important case is unfolding in Minnesota–eight people are being singled out by the government for their role in the political protests at the 2008 Republican National Convention (RNC).
At the September ’08 RNC in St. Paul, war criminal John McCain and right-wing religious fundamentalist Sarah Palin were being selected as the Republican ticket for the presidential race. The national media spent endless hours on things like Palin’s unmarried pregnant daughter. Meanwhile, the streets of St. Paul were turned into a militarized zone with massive police mobilization. Over the course of four days, thousands defied the armed clampdown to make known their opposition to U.S. wars-torture-spying and the imperialist globalization that has brought suffering to a huge section of humanity and caused catastrophic environmental damage. Over 800 people were arrested and scores were brutalized by the police.
Even before the protests started, law enforcement authorities carried out preemptive raids and arrests of activists and independent journalists throughout Minneapolis/St. Paul (the Twin Cities). Among those arrested were eight who are now being targeted for persecution, facing over 12 years in prison. They are known as the RNC 8.
For the first time, a state version of the fascistic USA Patriot Act is being applied to political demonstrations. The RNC 8 are charged with felony conspiracy to riot in furtherance of terrorism and felony conspiracy to commit criminal damage to property in furtherance of terrorism, along with two other felonies. They were sitting in jail for the duration of the Republican convention–but they are being held legally responsible for anything that any protestor did during that time.
The prosecution of the RNC 8 would set a very bad precedent that criminalizes political protest. But too few people even know about this case. Everyone who understands the importance of dissent and the ability to resist the crimes being committed by the government and ruling institutions needs to speak out. A big demand to drop the charges on the RNC 8 needs to be raised from a broad cross section of society. This railroad must be stopped cold in its tracks.

The Obama administration, siding with former President George W. Bush, is trying to kill a lawsuit that seeks to recover what could be millions of missing White House e-mails in a stunning reversal of Obama’s rhetoric about Bush secrecy on the campaign trail.
Two advocacy groups suing the Executive Office of the President, including one of the groups that helped derail former House Speaker Tom DeLay, say that large amounts of White House e-mail documenting Bush’s eight years in office may still be missing, and that the government must undertake an extensive recovery effort. They expressed disappointment that Obama’s Justice Department is continuing the Bush administration’s bid to get the lawsuits dismissed.
During its first term, the Bush White House failed to install electronic record-keeping for e-mail when it switched to a new system, allegedly resulting in millions of messages that could not be found.
The Bush White House “discovered the problem” in 2005 and rejected a proposed solution.
The exact number of missing e-mails is unknown, but several days on which e-mails were not archived covered key dates in a Justice Department inquiry into the roles of Vice President Dick Cheney and his aides in leaking the identity of covert CIA agent Valerie Plame Wilson.

Poisonous anthrax that killed five Americans in the weeks after the Sept. 11, 2001 terror attacks doesn’t match bacteria from a flask linked to Bruce Ivins, the researcher who committed suicide after being implicated by the Federal Bureau of Investigation, a scientist said.
Spores used in the deadly mailings “share a chemical ‘fingerprint’ that is not found in the flask linked to Bruce Ivins,” Roberta Kwok wrote in Nature News, citing Joseph Michael, a scientist at the Sandia National Laboratories in Albuquerque, New Mexico.
Michael analyzed letters sent to the New York Post and offices of Senators Tom Daschle and Patrick Leahy, and found a distinct “chemical signature” not present in the flask known as RMR-1029, which Ivins could access in his laboratory at Fort Detrick, Maryland.
“Spores from two of those show a distinct chemical signature that includes silicon, oxygen, iron, and tin; the third letter had silicon, oxygen, iron and possibly also tin,” Kwok wrote. “Bacteria from Ivins’ RMR-1029 flask did not contain any of those four elements.”
The results don’t necessarily exonerate Ivins.
The mailed spores could have been removed from the flask and grown under different conditions, resulting in varying chemical contents, Jason Bannan, a microbiologist and forensic examiner at the FBI’s Chemical Biological Sciences Unit in Quantico, Virginia, told Kwok.
“It doesn’t surprise me that it would be different,” said Bannan.

WASHINGTON — New documents show the CIA destroyed nearly 100 tapes of
terror interrogations, far more than has previously been acknowledged.
The revelation Monday comes as a criminal prosecutor is wrapping up his investigation
in the matter.
The acknowledgment of dozens of destroyed tapes came in a letter filed by government
lawyers in New York, where the American Civil Liberties Union has filed a lawsuit
seeking more details of terror interrogation programs.
“The CIA can now identify the number of videotapes that were destroyed,”
said the letter by Acting U.S. Attorney Lev Dassin. “Ninety two videotapes
ACLU attorney Amrit Singh said the CIA should be held in contempt of court for holding back the information for so long.
“The large number of videotapes destroyed confirms that the agency engaged in a systematic attempt to hide evidence of its illegal interrogations and to evade the court’s order,” Singh said in a statement.
The tapes became a contentious issue in the trial of Sept. 11 conspirator Zacarias
Moussaoui, after prosecutors initially claimed no such recordings existed, then
acknowledged two videotapes and one audiotape had been made.
The letter, dated March 2 to Judge Alvin Hellerstein, says the CIA is now gathering
more details for the lawsuit, including a list of the destroyed records, any
secondary accounts that describe the destroyed contents, and the identities
of those who may have viewed or possessed the recordings before they were destroyed.

the CIA acknowledged it destroyed 92 tapes of interrogations. The admission
comes in an American Civil Liberties Union lawsuit seeking records of the treatment
of prisoners in U.S. custody abroad. In December 2007, the ACLU filed a motion
to hold the CIA in contempt for its destruction of videotapes recording the
harsh interrogation of prisoners in violation of a court order requiring the

prisoners held in the US prison at Guantánamo Bay, Cuba.
The list, which is the result of three years’ research and writing about Guantánamo,
provides details of the 533 prisoners who have been released, and includes,
for the first time ever, accurate dates for their release. It also provides
details of the 241 prisoners who are still held, including the 59 prisoners
who have been cleared for release. Although some stories are still unknown,
the stories of nearly 700 prisoners are referenced either by links to Andy’s

The dithering and ducking going on in the Obama White House and the Holder
Justice Department over the crimes of the Bush administration are taking on
a comic aspect.
On the one hand, we have President Obama assuring us that under his administration,
there will be respect for the rule of law, and on the other hand we have this
one-time constitutional law professor and his attorney general declaiming that
there is no need for the appointment of a prosecutor to bring charges against
the people in the last administration, in the CIA, in the National Security
Agency and in the Defense Department and the military who clearly have broken
the law in serious and felonious ways.

Dear Senator Leahy,
We felt compelled to write to you regarding your recent call for the formation
of a “Truth Commission”. According to your press comments, this
Commission is supposed to look at the following:
* the politicization of prosecution in the Justice Department
* the wiretapping of U.S. citizens
* the flawed intelligence used to justify the invasion of Iraq
* the use of torture at Guantánamo and so-called black sites abroad
These are serious allegations of criminal activity by certain members of the
Bush Administration. While we applaud your initiative in looking into these
matters, we feel this approach is wrong.
As the Chairman of the Senate Judiciary Committee, you already have the responsibility
and legal authority to investigate matters relating to federal criminal law
without having to form a special commission. You are also bound by your oath
of office to support and uphold the Constitution by ensuring that those who
govern also abide by the rule of law.
Furthermore, a “Truth Commission” will not fix the real problems
that our country faces, nor will it guarantee that we will get to the truth.
The 9/11 Commission, which you want to model your commission after, is a perfect
example of that flawed process.
The 9/11 Commission was mandated to follow the facts surrounding the events
of September 11, 2001 to wherever they might lead and make national security

HOLT INTRODUCES ANTHRAX COMMISSION LEGISLATION Bill Would Create 9/11 Commission-Style Panel to Investigate Anthrax Attacks and Government Response
(Washington, D.C.) — Rep. Rush Holt (NJ-12) today introduced the Anthrax Attacks Investigation Act of 2009, legislation that would establish a Congressional commission to investigate the 2001 anthrax attacks and the federal government’s response to and investigation of the attacks. The bipartisan commission would make recommendations to the President and Congress on how the country can best prevent and respond to any future bioterrorism attack. The attacks evidently originated from a postal box in Holt’s Central New Jersey congressional district, disrupting the lives and livelihoods of many of his constituents. Holt has consistently raised questions about the federal investigation into the attacks.
“All of us — but especially the families of the victims of the anthrax attacks — deserve credible answers about how the attacks happened and whether the case really is closed,” Holt said. “The Commission, like the 9/11 Commission, would do that, and it would help American families know that the government is better prepared to protect them and their children from future bioterrorism attacks.”
